Welcome to ONIKA Tableware (“we”, “us”, “our”). By accessing or using our online store (“the Site”) and purchasing products from our online store, you agree to the following Terms & Conditions.

 

 1. Definitions

  • “Products” – Tableware and related objects offered on the Website.
  • “You,” “your,” “User” – Anyone using the Website.
  • “Order” – A purchase request submitted through the Website.
  • “Consumer” – A natural person acting for non-commercial purposes under Maltese/EU law.

 

2. Eligibility

To place an Order, you must:

  • be at least 18 years old, or have parental consent;
  • provide accurate and complete information.

 

3. Use of the Website/Online Store

You agree not to:

  • engage in unlawful or fraudulent activity;
  • interfere with the Website’s functionality;
  • attempt to access systems or accounts without authorization;
  • copy, reproduce, or use our content without permission.

We may suspend access for violation of these Terms.

 

4. Product Information

We strive for accuracy, but:

  • colours may vary by screen;
  • small variations may occur (e.g., in handmade items);
  • errors may occur, and we may correct them at any time.
  • most items are made and/or painted by hand.  Minor deviations in form and colour are no reduction in quality, but a feature of the product’s handmade and unique character. 

 

5. Pricing and Payment

  • All prices are shown in Euro (€) and include VAT where applicable.
  • Prices may change at any time before you place an Order.
  • Some photos depict multiple items to illustrate quantity or variation. Unless the description specifies otherwise, the listed price is for one item only.

Accepted Payment Methods

  1. PayPal
  2. BOV Mobile Pay
  3. Revolut
  4. Cash on Delivery (COD)

By placing an Order, you confirm that the payment method is yours and that sufficient funds are available.

Cash on Delivery:
Payment must be provided in full at the time of delivery. Failure to do so may result in cancelled Orders and refusal of future COD service.

If payment cannot be verified or processed, we may cancel the Order.

 

6. Orders and Order Acceptance

An order acknowledgement email does not constitute acceptance.

We may refuse or cancel an Order for:

  • product unavailability,
  • errors in descriptions or pricing,
  • payment issues,
  • suspected fraud or misuse,
  • delivery restrictions.

A binding contract is formed only when the Products are picked up or delivered.

 

7. Order Cancellations

Orders can only be cancelled before they are shipped/delivered.  Once an order has been fulfilled or shipped, it cannot be cancelled.

 

8. Shipping and Delivery

Delivery Areas

We currently deliver exclusively to Malta and Gozo.
We do not offer international shipping.

Delivery Fees

  • Free delivery applies to all orders of €75 or more.
  • A €5 delivery fee applies to orders below €75.

Delivery Times

  • Delivery will occur within 3-5 business days in Malta and 5-7 business days in Gozo. 
  • Delivery times may vary, with advance notice provided in such cases.

Risk

Risk of loss or damage passes to you upon delivery to the address you provide.

 

9. Right of Withdrawal (EU 14-Day Right)

If you are a Consumer within the EU, you have the right to withdraw from your purchase within 14 days from the date you receive your order.

To exercise this right, email us at onikatablescapes@gmail.com with your order details.

Conditions for returns under the withdrawal right:

  • Products must be unused, undamaged, and returned in their original packaging.
  • You must pay the return delivery costs (equivalent to the delivery cost) unless the item is faulty or incorrect.
  • Refunds will be issued within 14 days of receiving the returned items.

Exceptions:

  • personalised or custom-made items,
  • items used or damaged beyond basic inspection.

 

10. Damaged or Defective Items

If your order arrives damaged or defective, please contact us within 3 days of delivery with photos and your order number. We will arrange a replacement (if available) or refund.

 

11. Intellectual Property

All content on the Website—including images, product photos, text, graphics, and logos—is owned by ONIKA Tablescapes or its licensors.

You may not reproduce, distribute, or use any content without prior written permission.

 

12. Third-Party Links

We may include links to external websites. We do not control or endorse these sites and accept no responsibility for their content or practices.

 

13. Limitation of Liability

To the fullest extent permitted by Maltese law:

  • we are not liable for indirect, incidental, or consequential damages;
  • our total liability for any claim relating to a Product will not exceed the amount you paid for that Product.

This does not limit liability for fraud, negligence causing death or injury, or any non-excludable legal requirement.

 

14. Indemnification

You agree to indemnify and hold ONIKA Tablescapes harmless from any losses arising from your misuse of the Website or breach of these Terms.

 

15. Privacy and Data Protection (GDPR)

Your personal data is processed in accordance with GDPR and Maltese data-protection laws.

 

16. Changes to Terms

We may update these Terms from time to time.
Updates become effective once posted on the Website.
Continued use of the Website constitutes acceptance of the revised Terms.

 

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Malta.
Any disputes shall be resolved in the courts of Malta, subject to applicable EU consumer protections.
